ORDINANCE 14-01

AN ORDINANCE TO ESTABLISH THE AMOUNT OF CERTAIN FEES CHARGED BY KLAMATH COUNTY FIRE DISTRICT NO. 1 FOR VARIOUS SERVICES INCLUDING BUT NOT LIMITED TO EMERGENCY MEDICAL RESPONSE, HIGHWAY ASSISTANCE, SUPPRESSION BILLING, FIREMED, STANDBY, PUBLIC RECORDS, AND FIRE PREVENTION; AND TO PROVIDE THE EFFECTIVE DATE HEREOF.

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF KLAMATH COUNTY FIRE DISTRICT NO. 1, KLAMATH FALLS, OREGON:

Section 1. Fee Schedule.

A. Emergency Medical Response Fee Schedule.  The fees charged by Klamath County Fire District No. 1 for various Emergency Medical Responses fees shall be, and the same are hereby are, fixed in accordance with the following schedule:

  ALS I – Emergency and non-Emergency Base Rate $1,323.00
  ALS II – Emergency and non-Emergency Base Rate $1,425.00
  BLS – Emergency and non-Emergency Base Rate $1,130.00
  Specialty Care Transport (SCT) - Emergency Base Rate $1,578.00
  Emergency Aid Response $460.00
  Extra Attendant $230.00
  Transport Mileage, billed to nearest 10th of a mile $25.00/mile
  Assessment with refusal or no transport $0
  Assessment of death, no transport $1,000.00
  Care Facility Lift Assists (charged to the care facility) $225.00
  Discount for non-insured single payer within first 30 days - 20%
  Collection fees may be added to accounts sent to collections  

B.  Highway Assistance Schedule.  The fees charged by Klamath County Fire District No. 1 for highway assistance at all motor vehicle accidents are billed directly to automobile insurance.  Uninsured motorists may receive a bill directly. Initial charges are at a one-hour minimum.  All additional charges will be made to the closest ¼ hour.   Highway Assistance fees shall be, and the same are hereby are, fixed in accordance with the following schedule:

  Jaws of Life $50.00
  Flares $25.00
  HazMat Absorbent $50.00
  Aerial Truck $150.00 per hour
  Engine $100.00 per hour
  Water Tender $70.00 per hour
  Command Vehicle $15.00 per hour
  Firefighter $40.00 per hour
  Captain $45.00 per hour
  Fire Investigator $45.00 per hour
  Battalion Chief $50.00 per hour
  Division Chief/Fire Chief $60.00 per hour

C.  Suppression Billing Schedule.  Fire suppression services are generally funded through tax receipts received from property owners within the jurisdictional boundaries of Klamath County Fire District No. 1.  There are three specific situations in which Fire District No. 1 may bill for the cost of suppression services.   Initial charges are at a one-hour minimum.  All additional charges will be made to the closest ¼ hour.  

1.   State Mobilization:  When the governor declares the Emergency Conflagration Act and enacts the State Mobilization Plan, agencies that send resources outside their district may bill the State in accordance with a fee schedule established in the Mobilization Plan.

2.   Fires in Unprotected area:  If the Fire Chief or designee has been authorized by the Board of Directors to respond and extinguish fires found in unprotected areas and the fire is deemed to cause an undue jeopardy to life or property, the agency may bill the property owner in accordance with procedures established by the State Fire Marshal’s Office.

3.   Incidents involving an airplane crash or on a transportation route where the District receives no other direct tax:  For these situations in which the individuals/property owners pay no taxes, Fire District No. 1 may bill the recipient for the services rendered in accordance with procedures adopted by the State Fire Marshal’s Office.

D.  FireMed Fee Schedule.  The fees charged by Klamath County Fire District No. 1 for FireMed shall be, and the same are hereby are, fixed in accordance with the following schedule:

  FireMed Ground Ambulance Membership – one year option $58.00
  FireMed Ground Ambulance Membership – two year option $100.00

E.  Standby Fee Schedule.  Klamath County Fire District No. 1 may provide dedicated standby at various events, when personnel are available.  Initial charges are at a one-hour minimum.  All additional charges will be made to the closest ¼ hour.  The fees charged by Klamath County Fire District No. 1 for various standby activities shall be, and the same are hereby are, fixed in accordance with the following schedule:

  Ambulance Dedicated Standby $175.00 per hour
  Fire Engine Dedicated Standby $275.00 per hour

F.  Public Records Request Fee Schedule.  The fees charged by Klamath County Fire District No. 1 for various Public Records Requests shall be, and the same are hereby are, fixed in accordance with the following schedule:

Copies of Public Records; Certified Copies:   Copies of Public Records shall be billed based on personnel time required to complete the request.  The fee shall be $40.00 per hour, or actual cost of personnel whichever is greater, with a minimum charge for one quarter hour. Certified copies will include additional costs to cover legal fees associated with providing that record.

Copies of Digital Photographs and Sound Recordings:  Copies of digital photographs, sound recordings of meetings, and/or electronic copies of documents shall be billed based on personnel time required to complete the request.  The fee shall be $40.00 per hour, or actual cost of personnel whichever is greater, with a minimum charge of one quarter hour.  An additional charge of $5.00 per CD or DVD shall be added.  This does not include 911 recordings; requests for those recordings need to be made directly to the Klamath County Communications District, as they are the custodian of those records.

Copies of Maps and Other Nonstandard Documents:  Charges for copying maps or other nonstandard size documents shall be charged in accordance with the actual costs incurred by District No.1. In addition, fees for personnel time required to complete the request will be charged.  The fee shall be $40.00 per hour, or actual cost of personnel whichever is greater, with a minimum charge of one quarter hour.

Research Fees:  The fee shall be$40.00 per hour, or actual cost of personnel whichever is greater, with a minimum charge for one quarter hour.  District No.1 shall estimate the total amount of time required to respond to the records request, and the person making the request shall make payment for the estimated cost of the research and copying of the records in advance.  If the actual time and costs are less than estimated, the excess money shall be refunded to the person requesting the records.  If the actual costs and time are in excess of the estimated time, the difference shall be paid by the person requesting the records at the time the records are produced. This Public Records Research Fee schedule shall be posted at the administrative office in public view.

Additional Charges:  If a request is of such magnitude and nature that compliance would disrupt District No.1's normal operation, District No.1 may impose such additional charges as are necessary to reimburse District No.1 for the actual costs of producing the records. Such costs could include copying charges if use of outside copy equipment is required, postage, accounting or legal fees associated with providing that record; cost for the use of apparatus, equipment, or personnel as per the State Mobilization Plan; etc.

Reduced Fee or Free Copies:  Whenever the Board determines that furnishing copies of public records in its possession at a reduced fee, or without costs, would be in the public’s interest, the Board may so authorize.  ORS 192.440(4).

G.  Fire Prevention Fee Schedule.  The fees charged by Klamath County Fire District No. 1 for various Fire Prevention activities shall be, and the same are hereby are, fixed in accordance with the following schedule:

Residential and Commercial False Alarm Fee (per response)

*An Alarm User whose alarm signal generates more than two (2) false alarms per calendar year shall be charged a False Alarm Fee.  Each false alarm after the first two (2) is a separate offense.

Unlawful Fire Fee

Unlawful Fires are considered to be any burning outside of the allowed burning dates/times, or any burning of prohibited materials.  Any individual who ignites or maintains an unlawful fire will receive a warning the first time.  Any individual who ignites or maintains an unlawful fire twice will be assessed the unlawful fire fee.  Any additional unlawful fires will be assessed on an escalating fee of an additional $100 per occurrence.  (3rd unlawful fire will result in a fee of $200, 4th unlawful fire will result in a fee of $300, etc.)

Section 2. Existing Contracts. 
Where entities may have an existing contract in place for services that are also addressed in Ordinance 14-01, the existing contract shall supersede any fees listed in Ordinance 14-01.

Section 3. Collection of Fee.
Any fees are immediately due and payable within thirty (30) days of invoice.  If the invoice is not paid, it shall be subject to Fire District No. 1’s regular collection procedures.

Section 4. Repeal of Previous Ordinances and Resolutions. 
All ordinances and resolutions originally approved prior to the approval of Ordinance 14-01, and in conflict herewith, are hereby repealed.

Section 5. Severability Clause.
If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional or invalid, such unconstitutionality or invalidity shall not affect the validity of the remaining portions of this ordinance.  The Board of Directors of Klamath County Fire District No. 1 hereby declare that it would have passed this ordinance and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional or invalid.

Section 6. Effective Date.
This Ordinance shall take effect from and after its passage, approval, and publication as provided by law.
